Thank you so much for your quick response. The USICS only asked me to do appeal if I want, but it did not ask me to do motion and reopen. It seems that the motion and reopen is for I-485, not for I-140, right? My I-485 was completed by USCIS and I was asked to wait for interview. but I received the denial of I-140.

Please give more advice on my situation.

Right now I can only file Eb1(a) to have a pending I-485. My old one was done by myself.

Can you make sure that I cannot file the same category petition when one is in pending or appeal status?
If I do not appeal, according to your opinion, I can file the new petition, right? but I cannot work right now? how long will it take for me to get the new EAD? Thanks a lot.
