如果你申請reopen/appeal再次被拒絕，你的out of status時間是從CIS第一次拒絕I-485的時候開始計算，這時通常都已經逾期六個月以上了，不僅無法在美國境內調整身份，而且如果你離開美國，就3年到10年不準入境，除了打聯邦法院上訴，根本就沒有退路了。本來，是可以在境外重新簽H1B，回來再遞交一次I-485的，也可以用I-824把案子轉到領館去辦移民，因為I-140已經批準，機會是滿大的，根本沒有必要押寶在appeal這一棵樹上麵。
