Hi, Xiao Bai Tu, I have an urgent thing to ask. My J-1 will be expired in Aug. 29, I have applied for EAD and got it, since my hu*****and holds H-1 and we ted I-140 (approved) and I-485 (pending). My EAD is based on this I-485, My J-1 has been waived.
My question is I think I can use this EAD to continue work in the us. So I don't apply for the H-4 visa. Now the boss who had promised me to accept me as a postdoc in his lab suddenly told me that he could not accept me because of some reasons. I tried to discuss this thing several times with him, he sincerely said sorry for me. He could not do anything with this since the problem is the administrative office ( this is a federal government). Nobody can change the results.
Do you think I must have H-4 visa so that I can stay in the US? Now it seems that I don't have time to get H-4 visa before Aug.29. What can I do now to keep legal stay? If I don't have H-4 visa, do I stay here illegally? Or I must go back to China to get H-4 since I don't have time enough before Aug. 29?
