I do not think that your previous company will pay the sum for the premium process. Right now you need to make a decision. Obviously your previous lawyer won't admit that it is a mistake on his/her side. Your current lawyer does not want to file a H-1b transfer if the chance of your first case is slim, which will directly affects the fate of the transfer case. You need to clear the mess quick. And you do not have much time to lose. If you are sure that the offer from your current company is still there even in case your extension case is denied. Ask your current company to file and at the same time pay $1000 to speed the first case. In the worst case, the first case is denied. As long as the employer part of the transfer case is approved, you can still regain your H1 by applying for a H1B visa outside the US and come back .
