My H1-B expires Dec 2006. For me to extend it, I have to file Perm one year before then. Due to some delay, my company can only file my perm in May 2006. That is why I was asked to stay out of US for 5 months. That way, my current H1-B will expire in May 2007 instead of Dec 2006. Then I can extend my H1-B for the seventh year.
For the 5 months in China, I am still employed. I will use my vacation and non-pay leave to cover the 5 months.
In my case, how do I explain it during interview and reenering US? Can I tell them my true situaion?
