You can refile a new NIW at any time, or appeal the old one within month of denial. If you decide to refile,I think that your chance will be great if you can get more publications and references. As long as you have a pending or an approved 140 for over a year, you can extend your H1 for unlimited years at the pace of one year or three-year each time.
