I’d been happy for only one day after my labor certificate is approved. I’m feeling so frustrated after calling my attorney about filing I-140. My LC application indicates master degree and 24 months experience are needed. I did have much more than that but my attorney says it should be after master degree—I have 2 years and 7 months as a research assistant (20 hours per week)! I haven’t got the actual LC but he says it presumes 2 year after degree by the meaning of law. He filled out all my professional experience including all employers, responsibilities as well hours and he knows the job deions of the position that LC intends. How could it is possible to have such a mistake? He said we have to start over—prevailing wage, job order, ads, etc. However, why did DOL approve my case, just because of negligence? Can I just take some risk to go ahead for I-140? What is the chance?
I carefully read the application and found another concern: job deions involve more stuff than my experience, or more specific than what I ever did. Should thy match exactly? As I know, the position is for a future job does this means OK even if I don’t have the exact experience but I do have the ability (education and related experience)?
