如 果 用 AP 出 境 後 返 美 ﹐ 移 民 官 會 在 I-94 上 寫 下 AOS(adjustment of status) pending 的 字 樣 ,有 人 認 為 這 就 代 表 原 H1B 已 不 存 在 ﹐ 也 有 移 民 服 務 業 人 士 不 這 樣 認 為 ﹐ 可 謂 見 仁 見 智 並 無 定 論 ﹐ 至 於 EAD,因 使 用(出 示 ) 之 後 並 無 什 麼 痕 跡 ﹐目 前 還 沒 有 人 對 此 大 做 文 章 ﹐ 多 數 人 認 為 可 與 H1 同 時 並 存 。
