請教H4上海簽證(急!!)

I work in US with H1-B. I have a 16-year old son in China. He is the son I have with my ex-wife who already died. Two years ago, I was on F2 and my current wife was on F1. I asked my son to apply for F2 vias, but was denied. The visa officer wanted me to go back to apply for him. I didn't go back as I was afraid of not being able to come back. Now the situation has changed. I'm on H1-B and my wife is on H4. Can my son apply for the H4 without being denied again for the same reason? As I have no time to go back, Can I ask my wife (my son's step mother) to go back and apply together with him if necessary?
