cap doesn't seem to be the same from cap to cap or from nocap to noncap. I don't know any documents for that but there have been a former dicussion about this issue on this forum and the conclusion was that it is too irrational to transfer from noncap H1B to cap H1B without constaints.
It seems to me that your H1B have expired, and I am a bit worrying about your legal status. The only possible that you can hold on is the pending H1B transfer. So it would be much safer for you to wait until you get approval. After that, you will have 100% legal status, then your future will be much easier to apply H1B for you, of course with your newest H1B approval. Or else, with an expired H1B approval, things will be much more difficult.
