I am rushing to catch up the last buses for filling 140/485 concurrently before the October 1 cut-off. I have a question that I could not figure out an answer. Since the situation I envisioned might happen to all of us, the shocked birds of H-1b/H-4 bearers, I hope there are experienced friends helping to comb through a clarification.
If my I-140 was rejected, logically, my I-485 will be rejected too simultaneously. The worst situation was my wife already received her EAD card. Could she claim/restore her H-4 status or simply in a situation of loss-of-status? If this did happen,Does she have to leave the US so as to be re-admitted as H-4 independent,and is there any negative effect for applying a new H-4 visa outside USA because of an I-485 rejection? Is she able to apply for other non-immigration visa in US ( for example, H1-b) after having received a EAC card? What about my kid, he does not need to apply for an EAD card but did filed a I-485?
Waiting for your input, I will appreciate it so much.
