I am in CT, just call lawyer in NYC. Here is his comment:
(1). My lawyer says USCIS apprently want to help those
who filed LC in 2000 and 2001. He says he still has very
few LC-based cases, they filed LC in 2000 and 2001.
(2). My lawyer says he doesn't understand why EB1 has PD.
He says he has his EB1 cases before 2004 are all approved.
So EB1 may move fast.
(3). My lawyer says the most hit people are NIWers.
(I am one too). He says the PD for niwer is the date of
filing 140. So if you file NIW 140 after the cutoff date,
then your 485 will NOT be processed (I asked him twice
about this, he said NO). He also says the NIW cases
will NOT be seperated from EB2, i.e. not like nurses in EB3.
So the only chance for NIWer to get approved is before Oct.1.
Otherwise, you may have to wait for several years.
He also said he feel bad about me, since I file NIW last Aug.
and he said there is nothing he can do.
