還都有work permit?

No, undocumented immigrants generally do not have and cannot apply for a legal work permit in the United States. An Employment Authorization Document (EAD) is explicitly reserved for specific categories of foreign nationals who have an active or pending lawful status. However, there are temporary or case-by-case legal exceptions to this rule depending on an individual's specific circumstances. [1, 2, 3, 4, 5, 6]
Common Legal Exceptions
Some undocumented individuals can obtain a legal work permit if they qualify for specific federal protection programs: [1, 2]
  • DACA Recipients: Under the Deferred Action for Childhood Arrivals (DACA) program, individuals brought to the U.S. as children can receive renewable, two-year temporary work permits.
  • Asylum Seekers: Individuals who have crossed the border and filed an official application for asylum are permitted to apply for an EAD while their legal cases are being processed.
  • Parole in Place (PIP): Certain undocumented spouses of U.S. citizens can obtain temporary legal status and apply for work eligibility without having to leave the country.
  • Temporary Protected Status (TPS): Individuals from designated countries facing ongoing armed conflict or environmental disasters may qualify for temporary deportation relief and a work permit. [1, 2, 3, 4, 5]
