請教投壇的加州地主及檸檬律師，出租的condo被樓上漏水泡了

樓上牆內的進水管在澡池的開關和淋噴頭之間的一段漏了，水流到我的牆內，泡爛了drywall。因為漏水的地方在牆內，外麵無法看到。現在他的保險說加州的法律認為這不是他的negligence. 因此，不在理賠之內。請教各位大佬，要他賠償修理的費用還有戲嗎？這是他的保險的郵件：
