請教老師關於I-485 J 表的一些問題？

如果受益人的I-140 批準後I-485排期到了，由於某種原因受益人在排期到之前很早就更換了新雇主及H1B一直到I-485排期來臨。更換的職位屬於Schedule A 的緊缺工種，SOC Code和工作用的執照都一模一樣，新雇主和批準受益人I-140公司的性質也一模一樣，實力也遠超過它，給受益人的工資福利遠遠的超過舊公司辦I-140時的勞工部工資標準。新雇主也非常願意繼續擔保受益人的綠卡申請。舊雇主的I-140批準也都超過了180天，也沒有向USCIS提出過Withdrawal 。

那麽我的問題是如果受益人可不可以以舊的雇主批準的I-140向USCIS遞交I-485和I-485 J 表？
-If  the old employer (i.e. the I-140 sponsor) wants to hire you back after you get the green card, then you can use this I-140 to file I-485 and the old employer needs to sign the I-485 J. Otherwise, your new employer has to file a new PERM and I-140. Of course you can use the old I-140 priority date as the new I-140 priority date (i.e. claim the priority date portability), and you also can use the approved old I-140 to extend your H-1 beyond the 6-year limit.


I-485 的J表是新雇主(現在H1B的雇主）的信息資料，新的雇主簽名擔保。也就是說受益人在遞交I-485之前要不要重新Filed 一個新雇主的I-140 ？-Yes. See above.

因為I-485 J 表是2017年奧巴馬離任時實施的新政策，除了EB-1和EB-2 中的NIW 其他類都必須遞J表的。
