you do not need registration to protect your mark. once you start using it, it becomes a piece of interllectual property which has protection of state laws, common law, even lantham act.
however, with an unregistered mark, your use may be confined to the territory you have reached. if that company does not enter this twreitory, it may be ok, although with internet today it is hard to do so. if you bring the company to court, you will have higher burden of proof.
