4月14日，川普總統在白宮會見薩爾瓦多總統納伊布.布克爾/Nayib Bukele時, 川普總統表示，Kilmar Abrego Garcia 返美一案美國政府無能為力，薩爾瓦多總統布克爾也心領神會地表示，(司法之事)這事情我也做不了主。就這樣，借著克爾總統的掩護，川普總統公開對抗美國最高法院的裁決。
根據最高法院的判決要求，主審此案的美國聯邦法官 Judge Paula Xinis 判決川普政府司法部運用快速程序處理此案件，並允許Kilmar Abrego Garcia 的律師詢問政府行動的進展(做口供)／審閱相關文件。美國司法部不服判決，向聯邦上訴法院申訴，其申訴被上訴法院3:0否決。

川普總統第二任期用"總統行政令"治國的方式，讓國會幾乎成了擺設，"製約與平衡"這一美國政體的核心精神，隻能依靠司法係統來維持。在白宮與法院的頻頻對決中，"川普正在把美國變成集權國家"／"司法是否過多幹預政府執政"，成為當下兩個重要的時政話題。
在對Kilmar Abrego Garcia 返美一案最新裁決的解釋中，聯邦上訴法庭的三位法官從曆史／現實／人性的角度出發，用優美感人的筆調，提醒川普政府，挑起行政機構與司法係統的敵對, 會給雙方(國家)帶來的巨大危險:

"現在，權力分支之間的摩擦已經到了不可逆轉的地步，相互衝突隻會削弱雙方，"法官們說道。"這是一場所有人都會受損的爭鬥。司法機構將因其合法性不斷受到質疑而遭受巨大損失，而由於慣例和獨立性，我們隻能有限地回應; 行政機構則會因公眾對其無法無天的印象及相關的不良影響而受到重創"。(附錄1)

三位法官表示，行政部門"或許能在一段時間內削弱法院，但隨著時間推移，麵對[過往的雲煙與本可能兌現的承諾]之間差異，曆史的書寫將填補那一悲劇性的鴻溝，而法律最終將為自己刻下墓誌銘"。(附錄2)

法官們寫道,"正如我們所述，本案可能讓一個危機初現端倪，同時或許也帶來了機遇。我們抱有希望地認為，相信行政部門的優秀同人視法治為美國精神之根本, 依然不是一個天真的奢求。本案賦予他們一個獨特的機會來捍衛這一價值，並在還不太遲的時候，它也將喚起我們內心最好的品質"。(附錄3)

2025年1月21日，華盛頓"聖. 約翰聖公教堂" Bishop Mariann Budde 在她布道中請求川普總統對非法移民／LGBTQ 人群給予慈悲和憐憫(附錄4)；三個月後的今天，三位美國聯邦上訴法院法官在判決書中試圖喚醒川普政府執政的智慧。盡管他們訴求的具體內容有所不同，但都是在呼喚人性中美好成份。人性中美好成份是人們共存的基礎，社會繁榮的標誌。
也是三個多月來川普政府執政風格中欠缺的元素。

"Now the branches come too close to grinding irrevocably against one another in a conflict that promises to diminish both," the judges said. "This is a losing proposition all around. The Judiciary will lose much from the constant intimations of its illegitimacy, to which by dent of custom and detachment we can only sparingly reply. The Executive will lose much from a public perception of its lawlessness and all of its attendant contagions."

3. Court denies White House appeal of 'shocking' Abrego Garcia deportation case
"It is, as we have noted, all too possible to see in this case an incipient crisis, but it may present an opportunity as well," the judges wrote. "We yet cling to the hope that it is not na?ve to believe our good brethren in the Executive Branch perceive the rule of law as vital to the American ethos. This case presents their unique chance to vindicate that value and to summon the best that is within us while there is still time."
