MTA doesn't effectively enforce subway littering laws, so eating, drinking riders are not fined
Subway picknickers who leave their messes behind rarely get fined for their trashy transgressions.
Fewer than 2,000 subway riders - including those who eat while riding the rails - received tickets for littering last year, MTA statistics show.
And in more lousy news for passengers who detest subway snackers, only a few hundred riders were ticketed in the first two months of this year for a Rules of Conduct violation.
"It has to be observed by a police officer and I don't think people are prone to litter when they see a uniformed police officer," one police official said.
Doreen Frasca, chairwoman of the MTA transit committee, said on Monday that banning food and drink in the subways is a "swell idea." But MTA executives and board members have little appetite for the food fight that would ensue if they tried to pass a prohibition.
In 2005, transit officials were harshly criticized when they tried to enact a ban on drinking nonalcoholic beverages in the subways.
Some riders think subway noshing is stomach turning.
"There's no need to eat or drink on the subway," said Christina Parisi, 56, a secretary for a construction company who commutes on the No. 2 and 3 trains. "The other morning, I saw a huge rat carrying a plastic bag with a sandwich in it."
The litter these eaters leave behind isn't attracting much attention.
Precise data on litter enforcement is difficult because it has the same violation code as urinating, the MTA said.
Police issued tickets to 1,812 straphangers who relieved themselves of trash, or just relieved themselves （指大小便）, last year, MTA statistics show.
That's down 34% from the 2,769 tickets written the year before.
The transit committee of the MTA board is looking into the big problems caused by such trash underground - track fires and a healthy rodent population.
"Obviously, those situations are not acceptable," board member Mitch Pally said. "The transit committee is looking at how we can eliminate them as best we can."
The committee could seek additional funds for cleaning or see if it's possible to shift some existing staff toward the problem, Pally said.
MTA budget cuts have reduced cleaning staff by about 200 - or 9% - since 2007. Most of those were eliminated last year. There are now 2,465 train and station cleaners.
