撞車問題請教

老爸倒車慎，撞到後麵停著的車。雙方車均無擦傷，但 對方bumper 上有一凹痕（ 不在被撞部位），很難判斷是否是這次被撞傷的。因是老爸的錯，所以給了對方我們的保險。
問題是現在意識到對方車是停在 illegal parking area，這種情形下，仍該我們的保 險賠償嗎？
