Do you think the producer of an engine oil failed the rated performance will win a law suit?  By the way, the capability of dealing with temperature of lube oil is not only depending on additives, but also the carbon chain structure.  For example, a chain with a lot of double bonds will fail rapidly.  That is the major reason do not use chain store recycled oil.  Aged oil has more double bonds and fatty acids.
