when you see a car stopped like that, you should anticipate that the car was about to do a parallel parking. Don't assume that the driver of that car saw you either. You should either use you horn to alert the driver or you should leave enough room so you can safely drive around the other car.

Now, without witness, it will be your words against his and you probably will get 50/50 fault.
