車禍的問題

今天早上第一次雪天開高速去機場，路上比較滑，所以一路都很小心。快到機場的時，路上的雪也基本沒了。此時我正開在左lane上，突然間右邊前方不遠的一輛suv往左換lane（我記得他沒有打燈）。當時我離它隻有10米左右的距離，我的第一反應是一腳將刹車踩死。可是根本沒用，眼睜睜的看著我的車吻了前車的屁股。

然後我們都靠右把車停在緊急停車帶上。對方是一年輕老美。他撕下一張巴掌大小的紙，寫下他的名字和電話給我。我向他要保險和駕照，都被他拒絕了。於是我也隻給了他我的名字和電話（後來我們電話中交換了insurance信息，聽口氣，他已經打過電話給他自己的保險公司）。

我問他為什麽突然換道，他說他沒有，是我開得太快了。我清楚地記得一路上都有雪，而我一直都開在50邁以下。後麵路況好了後我也隻開到50到60之間,應該低於限速。我還記得當時他前麵的車減速了（我看到刹車燈亮了），可能他不想減速，於是突然換道，這樣才撞上了的。我跟他解釋，他說讓保險來判吧。

我想他應該是覺得我的車前部撞到了他車的後部，如果按照追尾算的話，肯定是我輸。但是實際情況是他的車突然往左換道，我根本躲避不及。當時拍的照片也能說明這個事實：我車的右前部和他車的左後部有明顯的損壞（請看附帶的照片）。並且，我的車裏還有兩個目擊者：我老婆和一個朋友（不知道他們能否算人證）。

請問：

從照片分析，我的勝算如何？

教訓：

1.看到前方旁邊道的車刹車，一定的注意其後的車，因為有些司機不願減速直接換道。
2.如果緊急刹車，最好不要一腳踩到底。今天我刹車踩的連人都要站起來了也沒有用。麻煩哪位老司機說說這種情況應該怎麽辦。
