All legal matters are facts based. It depends on what happened during that hour. Let's say you were abducted by bad guys for ransom and freed yourself after 1 hour and arriaved at home, you would plea "not guilty." On the other hand, if you were meeting your secret lover in your neighbourhood while your hu*****and was at work, you would plea "guilty."
This is a big world, don't assume we all know the facts. As a lawyer, the first lesson I learned in practicign law is --- assume nothing.
I am not making fun of you. I am just saying that if you want people to be able to give you useful advice, lay out the facts.
I am not sure what you should plea.
