As long as there is damage, no matter personal or property, the damaged party can sue, as long as you allege proximate causation from the defective product to the damage.
The lawyer's job to prove the proximate causation exists.
Frankly, this case is just too small for product liability. Usually the victim sue for death or lifetime disability. But I suggest the LZ for new theory of attack.
