盡量客觀陳述如下。
我家換房頂,先交了一半定金,完成後7天之內交付餘款。現在的問題是關於“完成-complete “的定義和理解。房頂是換完了。但是1)新換的瓦片在房頂角落的位置直接滴水,2)gutters在換完之後大部分漏水。因為工人直接踩上了gutters 在施工的過程中。和包工頭反應之後過來維修了兩次,情況依舊沒有改觀。包工頭催逼餘款。我很明確你的工作沒有完成,我是不會付餘款的。包工頭大怒,說1) “It’s very common for the corners to leak because they don’t have enough support to handle the weight of water and snow.” 2) “It obviously leaked before the job and you never noticed it.”
然後包工頭提出讓我付清“餘款-暫扣1000$”,他才會啟動找人維修gutters only, 修完後我要立刻付清暫扣的這$1000。我要求明確維修gutters 的cost 誰承擔?新的shingles 滴水也必須維修。結果包工頭又怒,不給我任何明確答案,說“ This is non-negotiable. I know that the gutters were not damaged because I have before and after pictures of the gutters after the job. I’m only replacing them to facilitate a payment from you. If you do not make the payment by XX date, I will be forced to place a lien on your home and file a lawsuit against you for the payment. Then you will be responsible for all the accrued interest and court costs. Make arrangements for the payment as soon as possible.”我想問問應該如何處理這個事情?
1)把餘款7000付給包工頭,他造成的新瓦片滴水(包工頭認為正常現象)和gutters 漏水200%不會管了,除非我再去打官司起訴他。這不是我想要的結果。當初開工之前專門留下一半餘款在結束工程後再付就是為了保護消費者的權益吧。
2)根據包工頭建議,先付7000-1000=6000,然後他派工人過來維修gutters,但是始終不明確修理費用誰負擔?如果是我負擔,這和上麵第一個選擇沒有區別。
3)始終強調新瓦片漏水是正常現象.
4)房子是老公的名下,我不在房產裏麵。簽訂換房頂的合同是我簽訂的,老公不在h換房頂合同上麵。
