On their service contract, inspector usually disclaims any defects behind walls where they could not see. Even if he is responsible, he is only responsible for the inspection fees you paid ($200-300).  He is not responsible for the actual damages.

The seller might claim he doesn't know about the leak.  Past leaks are not evidence that present leak exists and known.
