How much money? If not affect your parents' life, just forget a

From what I know, sometimes, knowing a judge can affect the out come of the trial. Without borrowing notes, it is difficult to argue that the money is not gift anyway. Unless you have siblings in China want to fight this, try to ask your mom to forget and forgive. Old people going to court won't be fun. 

To be honest, you and your family should not "pursuade" your cousin at the first place.
