學習了8老師回答同學們關於父母移民為21歲以下子女移民的年齡計算問題。不知道我這樣的理解是否正確，假定I-130 receipt date是2015年11月1日，小孩出生年月是2006年11月1日，I-130 approval date 是2019年11月1 日。

1. Visa bulletin 每個月公布的date 是指I-130 receipt date 遞交的130表的申請人可以開始遞交485申請了，對？ 比如現在公布的日子是2003年2月8日，這意味著如果申請人是2003年2月8日遞交的I-130, 如果你的I-130已經得到批準（假定在2003年2月8日到今天2015年10月21日的某一天批準的I-130), 你現在可以遞交I-485了， 對？

 

這個公布的date 不是你I-130批準的日期，而是你遞交的時間。我們平時所說兄弟姐妹移民一般需要12年左右的時間，是指從公民遞交I-130的時間開始，而不是從I-130 批準時間開始算。

2. 如果第一條理解正確，那麽8老師指出的 CSPA age = the child age when the PD is current - I-130 pending time, 就可以理解為I-130 pending 時間越長，越容易滿足CSPA age < 21, 對？

-Correct.

 

假定上麵這個情況，如果從I-130遞交到I-130 PD current 經過了15年，也就是說I-130 receipt date是2015年11月1日，小孩出生年月是2006年11月1日，I-130 approval date 是2019年11月1 日， I-130 PD current是2030年11月1日，那個時候小孩的CSPA age 應該是24-4=20， 小孩實際年紀是24歲，但CSPS age 是20，對？。 這樣仍然可以隨父母移民

3. 如果以上理解正確，當PD current後，弟弟可以為本人妻女遞交I-485, 從準備遞交I-485到批準I-485可能又會經過一段時間（一般多長？），這個等待時間會影響CSPA age 的計算？

-No. -As long as the child files I-485 or submits the immigrant visa application form (DS 260), then the child's CSPA age will be frozen

 

上麵the child age when the PD is current  的計算是以visa bulletin 公布的日期算

-Yes. You can calculate it by yourself when the PD is current, and then submit the immigtrant visa application (outsider US) or I-485 (within US) if the child is not age-out. Of course, USCIS will verify whether the child is age-out or not  before they approve the green card.

 

還是移民局專門有個書麵通知確認這個CSPA age ?

-No.
