上次已經谘詢過8老師，鏈接如下，確認可以直接替我兒子file extension。

我跟公司律師溝通後，公司律師仍然堅稱不能保證沒有I-94 gap，但提出file H1B amendment的替代方案。

那就是以work location變動為由，用一個新的公司地址和我家庭地址（WFH）作為新的work location。（我們公司的building很多，有多個street地址，距離都在方圓5 miles以內。我家離公司也是20個mile以內）提交H1B amendment of work location change。實際上這種距離都是within the same metropolitan statistical area (MSA)，壓根沒必要提amendment，也不知道會不會被拒。當然USCIS應該壓根不會查距離。

律師說amendment裏可以注明start date為6/2/2023（我兒子護照過期時間），然後USCIS會按此start date給新的三年，6/2/2023 - 6/1/2026，跟延期等效。

聽起來似乎很完美。想請8老師幫忙看看，是不是有什麽risk。

-Even if there is a gap in your child's status, there will not be negative impact on your child's future status extension or green card application as I addressed in my previous response. So, it is fine to file the H-1 and H4 extension before June 1. Also, you and your child may tralvce to China after the H1/H4 extension is approved. Thus, when you return to US, your child will get the new I-94 for new H4 duration and the gap will be cancelled.

Of course, it is also fine to file H-1 amendment as the lawyer said.

我聽說USCIS常常胡亂給3年有效期。這個amendment雖然會批三年，但會不會真正有效的隻有幾個月（截止至7/1/2023，我的H1B過期日）。amendment隻是對當前H1B的修改而已，並不能起到延期的作用？

-Your employer/lawyer can request the H-1 amandment and H-1 extension at the same time in one I-129 petition.

If you worry too much, your child may file I-539 for H4 extension from June 1 to July 1. Then, he/she can file another H-4 extension together with your H-1 extension with the effective date on July 1. Of course, this will cost you an extra H4 extension filing fee.
