In an ideal time, IRS would start an audit on your husband because IRS received duplicated tax returns. But ever since COVID IRS is backlogged, and I am not sure when they will get to see your paper return. So if you just want to file a return, do it in paper.
That leaves us two questions
(1) what about your part of tax refund. If you have a W-2 job and you are due a refund, and if that refund was sent to your husband based on his fraudulent return, you should bring this issue in your next divorce proceeding to recover the refund together with your property division in the divorce case.
(2) Did your husband commit a crime? Yes, he filed a fraudulent tax return. If you want him get punished, you need to consult a lawyer.
