Sympathy is more objective, while Empathy is more subjective

A sympathy is a feeling toward a fact, such as somebody in an unfortunate situation, not whatever the cause.

Empathy is more subjective, to understand from the persons perspective.

The word empathy now has been too often abused, in situations that we are asked to have empathy, i.e., to be thinking from the perspective of people who are either criminals or people fall short of what a decent person should be. In other words, empathy is a one that covers all tool to give bad guys excuses.

You got robbed and beaten up? Sorry (that means, I am expressing my sympathy...), but you have to have empathy; that guy grew from a poor family and violent environment and you must not be angry...

When one discusses these words one must consider the current context how these words are used.

When you choose sympathy toward the victim, and empathy to the criminal, you are pretty screwed up...
