申請職業移民用 I-140

讀此文之前，最好先了解一下“美國綠卡申請入門”。
除非你是申請 EB-1a 或是 NIW，這張表格是應該由你的雇主，或是雇主的律師來填的。
填此表的目的，是申請工作移民的資格。關於優先級別和排期，在＂入門＂中已作過介紹。現在著重在填表上。
I-140 是移民資格的申請，其受益人可以在地球上的任何地方，不是必須在美國境內。正在美國境內的話，其目前身份不影響申請，即使是沒有身份也無關係。

Part 1. Information about the person or organization filing this petition.
填表人的情況。
個人 (EB-1a, NIW) 填姓名 (Name)、U.S. Social Security No，公司填名稱 (Company or Organization Name)、IRS Tax No.
Address 為街道地址，非郵箱。
Part 2. Petition type.
申請的優先級別。
a. An alien of extraordinary ability.
- EB-1a
b. An outstanding professor or researcher.

c. A multinational executive or manager.

對於 NIW 來說，你 waive 掉的是 PERM，不能沒有 Job Offer. EB-1a 如果沒有工作，問題倒不是太大。

這是單一選擇題。
如果人在境內，通常是AOS. 如果改變了主意，就填 I-824 （要交費）改成 CP.
在境外的話，填 CP. 入境之後若排球期當前，也可以交 I-485.
搞不懂為什麽總有人問，這裏可不可以不填。如果你沒有 spouse/child，自然沒得可填了。如果有的話，還有此問，是不是有計劃要換 spouse/child 呀？
列在此處的 spouse/kid 不算有移民傾向。

餘不贅言。
I-140 的申請地址，按照申請人的地址，依轄區分別寄到 NSC 或 TSC.
如果受益人的排期當前，申請人的 I-140 和受益人的 I-485 （還有附屬的 I-131/I-765）可以同時提交，目前 EB-1 類總是如此。這時，Concurrent Filing 的地址，NSC 有些不同。
境外申請 I-140，請寄 NSC.
文件清單
自從去年大放水時 I-140 的加快服務 (Premium Processing Service) 無限期暫定之後，一直沒有複活的跡象。本周 USCIS 新發了文，說從 6/16/08 起，I-140 的 PP 服務有條件地恢複。
這個條件，就是受益人的六年 H-1b 即將到期而不符合延期的規定。
移民局的原文是：
Premium Processing Service, for Forms I-140 filed for alien beneficiaries who, as of the date of filing the Form I-907:
換一個方式說，條件是：在 H-1b 的第六年中才開始申請綠卡，且 I-140 在 H-1b 六年期滿前 60 天內尚未批準者，可以提交 I-907 來申請 I-140 的加快服務。
反過來說，對於在 H-1b 第六年之前就開始綠卡申請的同學，因為滿足 106(a) of AC21 的條件可以延一年，不能申請 PP 服務。
對於排期是在 H-1b 五年期滿前 60 天內的同學，由於在 H-1b 六年期滿時其綠卡申請 pending 超過一年，按 106(a) 的條件可以申請一年的延期。但是，有一個擦邊球可以打。
因為是否滿足加快服務的條件，是依填 I-907 表的那一時刻來判斷 ("as of the date of filing the Form I-907"). 如果很好地選擇一個填表日期，就可以鑽空子要求 PP Service. 這個日期，就是在 H-1b 六年期滿前 60 天內而在排期的 Anniversary 之前。
假設王五同學 10/1/2002 步入 H-1b，於 8/25/2007 申請 PERM. 其六年期滿時 9/30/2008，因為 PERM 已經一年，可依 106(a) 延第七年 H-1b. 但王同學可以在 8/2-8/24/08 間申請 PP Service，因為 1) 是在 H-1b 六年期滿前 60 天內；2) 填表時不滿足 106(a).
I-140 的加快服務是 Premium Processing Service，而不是 Expedited Approval（特快批準），所以 15 天加快服務的結果可以是 1) Approval, 2) Denial, 3) Notice of Intent to Deny, 4) RFE, or 5) Notice of Investigation for Fraud or Misrepresentation.
申請加快服務，除了 I-907 外，還需要下列文件：

反過來說，對於在 H-1b 第六年之前就開始綠卡申請的同學，因為滿足 106(a) of AC21 的條件可以延一年，不能申請 PP 服務。
對於排期是在 H-1b 五年期滿前 60 天內的同學，由於在 H-1b 六年期滿時其綠卡申請 pending 超過一年，按 106(a) 的條件可以申請一年的延期。但是，有一個擦邊球可以打。

我目前是F1身份，專業是EE，在學校做RA，明年年底或2010年初畢業，想DIY申請NIW和Eb1a.
Q1: 第一部分和第三部分的地址是否應該填同一個。如果是，那麽 suite# 填什麽，是
否就是apt#
Q2: 第三部分中的A#是什麽？另外想確認一下，Date of Arrival 是最近一次入境時間
；Date Status Expires 應該填 d/s
Q3: 第五部分中 Occupation是PhD candidate ； annual income 填 RA 的 工資。
Q4：第六部分中 Job Title 可否填 Graduate Research Assistant；SOC Code 應該匹
配什麽，找了半天都不敢確定。
Q5：第六部分中
Is this a full-time position? 是否該填yes, 但是大家都知道 RA 在 offer letter
都寫明是 工作20個小時左右。而且困惑的是 在第9項 Wages per week 錢就顯得很少。
Q6：第七部分中我填了我LP的名字，我們兩個人是不是隻要遞一份 I140 表格交一份錢
就行了。
Q7: 想知道根據我的畢業時間，什麽時候申請比較有利。如果在畢業前申請被拒，會不
會影響F1身份和工作。
