In fact, most employment-based visa applicants do not need to file an I-864. The following immigrants are required by law to file an I-864 with their I-485: · All immediate relatives of US citizens; · All family-based preference immigrants; and · Employment-based preference immigrants in cases only where a US citizen or lawful permanent resident relative filed the immigrant visa petition or such relative has significant ownership interest (5% or more) in the entity that filed the petition. For employment-based visa applicants, that means that there is no need to file an I-864 unless you work for a family member in some capacity. Furthermore, if the applicant can establish on the basis of Social Security Administration records that he or she has already worked or can be credited with having worked 40 quarters (ten years) of covered employment, then under a new rule promulgated by USCIS they do not have to file the I-864.
