January 2006 Visa Bulletin

January 2006 Visa Bulletin is Now Available By: Nicole C. Dillard, Esq. The Department of State has just released the January 2006 visa bulletin. This bulletin reflects any movement that has occurred regarding the availability of visas, information especially useful to those who are currently restricted from applying to adjust their status to become permanent residents due to the inability of visa numbers available for nationals of their country. Upon reviewing the January bulletin, it appears that several of the Employment-based categories that have previously had significant wait times for oversubscribed countries, have experienced some movement. Specifically, in the Employment Based category 1, which includes Aliens of Extraordinary Ability and Outstanding Researchers and Professors, the priority date for Chinese nationals is now January 1, 2002, a movement of approximately 6 months from the December visa bulletin. The priority date for Indian nationals in this category is July 1, 2003, a movement of 4 months from the December bulletin. In the Employment Based 2nd Preference category, one that covers Aliens with Advanced Degrees and those seeking National Interest Waivers, for Chinese nationals, the priority date has now moved to June 1, 2001, 3 months of movement from the December bulletin. Indian nationals in this category experienced movement of approximately 5 months, from July 1, 2000 to January 1, 2001. For the Employment Based 3rd preference categories, all of the oversubscribed countries experienced some movement, anywhere from 1 month to 6 months of progress in the priority dates that are currently being processed.
