right, 401K / IRA doesn't go through probate

If the beneficiary is spouse, it can be rollover to spouse's account directly.

If the beneficiary are children or other non-spouse, it has required withdrawal period, usually 10 years.  The withdrawals would usually be subject to income tax rate of the beneficiary.
