親愛的國會議員先生/國會議員女士:
我對加聯邦政府“加拿大服務局”（Service Canada）的一些辦事機構的管理混亂及效率低下的官僚主義及一些公務員的濫用職權感到非常震驚.我1996年3月入境加拿大至今已在加居住了13年多了,實際上早已超過所要求的10年的在加拿大居住時間,完全有資格申請老人金了,2012年9月我遞交申請表後,他們一直采取不公正的態度對我,采取刁難故意拖延的手段來應付我的老人金申請.至今不給我任何答複.
An open letter to the Federal Government of Canada’s “Service Canada”
Dear Mr/Ms. MP ,
I’d be very much shocked at a chaotic management and an inefficient bureaucracy in some of the offices of the Federal Government of Canada's "Service Canada" and some of its civil servants ‘abuse of power as well. I entered Canada in March 1996, and since then I’ve been actually living in Canada for more than 13 years that have already exceeded 10 years’ residence time eligible for OASP benefits . Since I submitted the application form for OASP in September 2012, they have been taking unfair attitude towards me, and taking the means to make things difficult for me to procrastinate my OASP application.
從去年九月我開始申請老人金到我今年八月二十五日滿XXX歲已經整整一年多的光景過去了,但申請老人金一事仍然毫無任何進展.自我遞交申請表開始,我記得他們前後一共隻給我來了兩,三封信,第一封信要我向加拿大邊境局索取我從1996年3月來加拿大之後的所有出入境記錄,在社工幫助下,我很快就獲得加拿大邊境局寄來的包含所有我入境記錄的信,來信中特別注明加拿大邊境局沒有當事人的出境記錄,隻有入境記錄.
From September last year when I started applying for the old age pension till to my birthday this year when I turned XX ,more than a year has passed, however the application for my OASP has still made no progress. From submitting the application till now, I remember they only sent me two or three letters altogether, the first letter saying that they required a certified copy of my full travel history from March 1996 up to now from Canada Border Services Agency . With the help of the social worker I soon got the letter from CBSA containing my full travel history. The letter specifically emphasizes that CBSA can only retrieve entries into Canada ,and does not track exists.
我將加拿大邊境局寄來的包括有我所有入境記錄的信的原件及附帶了我的一封說明信,信中我特別注明我可提供我的護照上的所有簽證和所蓋的出入境章的複印公證件來輔助性地佐證加拿大邊境局的所有入境記錄.並將這封信寄給Service Canada.出乎我的意料,在過了一個多月後它來信竟莫名其妙地要我提供香港的出入境的記錄,我當即回複他們因我從未到過香港,無法提供此記錄.
I sent them the original letter from CBSA enclosed with one letter in which I specify that I can provide the certified copies of all visas including all entry & exist stamps on my passport as supporting proofs. More than one month later, quite accountably, they sent me a letter to require me to provide a Statement of Travel records issued by the Immigration Department ,the Government of the Hong Kong ,Special Administrative Region. I immediately wrote them a reply that I was unable to provide such a Statement of Travel records because I ‘ve never been to Hong Kong.
經我再三解釋後,他們極不情願地承認他們搞錯了,之後更荒唐的是又來信要我向他們提供一個根本不存在的所謂的國外機構出具的我的出入境記錄.這也是我不可能辦到的事.並因此向他們闡明我的立場.
After I repeatedly explained the reason why I was unable to do it, finally they reluctantly admitted that they ‘d made ??a mistake. Even more ridiculously ,later they wrote me that they asked me to provide the travel records issued by an non-existent foreign agency .Similarly as before I can not provide them , and thus I clarified my views on it to them.
從他們的所作所為中我就看出來了他們這是故意刁難人,就是故意設置障礙,拖延時間盡量不給你老人金,這是明顯無理的侵犯法律的行為,是一種肆無忌憚地來剝奪他人應該享受的權力的行為.
From what they have done I can see through their tricks which mean they deliberately make things difficult for people, and deliberately set up obstacles to delay as long as possible in offeringyou OASP.Their actions are an obvious & unreasonable violation of the law. Their actions also unscrupulously deprive others ‘right to having the OASP.
嚴格說來這也是一種侵犯人權,侵犯公民權利的不法行為.另外具我觀察他們機構內部管理也是極其混亂的,無規章可尋,比如,一個辦事員對你承諾的事,另一個辦事員可以當即推翻,另行安排一套,讓你無所適從,感到十分無奈.
Strictly speaking ,this is a violation of human rights, and a violation of civil rights. Additionally, I’ve observed that their office management is extremely chaotic.No rules can be followed, for example, one of their officers promises you one thing which can be immediately cancelled by another officer ,and will be replaced with a new one.So you don’t know what to do, and feel helpless.
從新聞報道上得知,由於當今政府經濟困難,收支不平衡,老人金支出缺錢,就此加拿大聯邦政府已經削減了老人金的支出.
I’ve learned from the news reports that due to the current federal government ‘s economic difficulties , unbalanced revenue and expenditure ,and insufficient funds of old age pension , for these reasons, the Canadian federal government has cut down the old age pension expenditure .
他們就把這困難轉嫁到了退休的老年人身上.不公平地將合資格的受益者的合法權益剝奪,絞盡腦汁找出各種理由硬說你尚無資格領取老人金或者借口硬說你居住時間不夠,要你耐心等待,他們就是通過這種損人利己的方式,來為國家節約開支.
They shift the financial burden on to those eligible beneficiaries who’re unfairly deprived of the legitimate rights and interests .Then they rack their brains to find all sorts of reasons to stubbornly insist that you are not eligible for the old age pension or find an excuse to say you cannot meet the residence requirements for OASP. They want you to be patient if it takes a longer time for you to wait. They save money for the country by means of harming others to benefit themselves.
而且他們這樣做是有選擇性,就是選擇最弱勢的族裔-----華裔下手,據稱有的華裔老年人被拖延了三年才領到老人金.而且他們根本不會為此對你作出的任何合理解釋,即便你已經早就居留夠十年的時間了,他們仍然蠻橫無理地硬說你居留時間還不夠,還要等待.
And they selectively do so to choose the most vulnerable ethnic Chinese for a start ----- some elderly Chinese have allegedly been delayed three years receiving the old age pension. And they won’t’ simply give you any reasonable explanation of their misconduct, even if you stay long enough to meet the residence requirements for OASP , they still arbitrarily claim that you haven’t dwelt long enough to meet the requirements , and they still obstinately asserted that you would have to wait for receiving your OASP.
他們就像這樣濫用手中的職權,非法地強行剝奪他們應該享受老人金的權利,這些受害老人因沒有收入來源,他們的生活處於貧困的境地, 到處去尋找救濟中心,去解決一日三餐的吃飯問題.
They abuse their powers unlawfully like this to deprive the senior people of their right to having the OASP . Since these old people have no source of income, they live in straitened circumstances. They ‘ve been everywhere and try to find the Poor Relief centres to solve the problem of eating three meals a day.
其實在加拿大,就業機會,福利待遇不平等,不一視同仁,搞種族歧視的情況是普遍存在的,如象上述的這些華裔老年人領老人金受到不公正的對待就是一實際的例子.目前在多市尚有一大批居住超過十年,有的甚至超過十三年的老人都還沒有領到老人金.
In fact, in Canada, not every people is treated equally where the same circumstances ,such as job opportunities, and welfare benefits apply. Some racial discrimination on ethnic groups in Canada remains widespread, the above-mentioned those Chinese seniors who haven’t received OASP is a practical example of unfair treatment .Currently many of the Chinese seniors who ‘ve been living in Canada for over a decade, and some of them who’ve been living for even more than 13 years have not yet received the OASP.
據有關權威人士透露這是因為加拿大政府目前麵臨的困難經濟形勢,很難應付龐大的老人金的開支所導致的,而且已呈現出的這樣的困難情形未來(老人金資金短缺的狀況)還將會進一步惡化.
According to some relevant authoritative sources , it is because resulting from the current difficult economic situation that the Canadian government can’t pay the huge old age pension expenses. However the difficult economic situation that has already shown (the old -age pension fund shortage )’ll further deteriorate in the future.
為了減少支出,加政府也不應該將這一經濟困難轉嫁到老年人身上, 據有關消息靈通人士透露政府醞釀已久改變以前所製定的的養老金的居留政策即:一年中離境不超過半年的,仍按居住一年計算.
To reduce their expenditure on the old –age pension, the Canadian government shouldn’t shift the economic burden on to the elderly people .According to some relevant informed sources ,the government has been brewing for revising the previously formulated policy on the residency requirement .The existing policy as it is related to that as long as you don’t leave Canada for more than 6 months within one year, the rules are that your residency time should normally be counted as one year.
今後將改變成一年中隻要你離境時間不管你超沒有超過半年,即使離境時間不到一個月也要算你這一年的居留時間為零.
In future the policy ‘ll be changed. No matter whether you leave Canada for less than 6 months ,even less than a month within one year, your residence time ‘ll be counted as zero residence.
估計現在他們就是在等這項居留政策修改,一旦新政策實施後,他們就會趁此機會將一大批現在他們找出各種各樣理由故意拖延不發老人金的其實早就已居留夠十年的老年人全部取消掉享受老人金的資格,我就是屬於他們其中的一員.
Estimatedly now they are waiting for revising the policy .When once the new one is implemented, they will take this opportunity to deprive large numbers of eligible seniors of their legalrights to having the OASP ,now in view of this situation these elderly people to whom they find a variety of reasons to deliberately delay offering the OASP, actually these elderly people have long been living in Canada for over a decade. I belong to one of them.
現在他們采取辦事拖拉的策略,對當事人的老人金申請案子長時間的置之不理,不答複,或不處理.盡量拖延時間,盡量扣除你應該獲得的老人金.
Now they use a dilatory strategy to ignore or not to reply to the applicants or not to process their files for a long time. They try to stall for time, so that they try their best to cut down the OASP which the elderly people should get .

2,從我所提交的加拿大邊境署提供的入境記錄，有返回加拿大的日期。他們需要與其相配合的離境加拿大的日期，返回到加拿大的日期如下：

1.I’m required to provide proof of my departure from Canada in December 1999.
2.On the Canada Border Services document I submitted, there were return dates to Canada. They need to dates of departure that match with the following dates of return to Canada:
a. Returned to Canada February 28,2007
b. Returned to Canada August 13,2007
c. Returned to Canada April11,2008
d. Returned to Canada April 29,2009
e. Returned to Canada July 12,2011
f. Returned to Canada May 2013
我已於2013年10月中旬全部提交了上述要求的經公證後的證據.

時間已經過去快兩月了,他們仍是采取不答複的態度來拖延我得到老人金, ,他們利用手中的權力無理地剝奪我的應該享受老人金的合法權力,我能在什麽地方去申述以求得到法理上地合理解決問題?
Nearly two months has passed, they still take their non-response attitude to delay my receiving OASP . They use their powers to unreasonably deprive me of the legitimate right to having my old age pension. Where can I go to make a claim to getting a legal reasonable solution to the problem?
這樣長期拖延下去,我想最後我們是不會得到任何結果的,我建議把我們雙方的證據提交給一個法律仲裁機構裁決由它作出最後的決定.當然求助於國會議員或求助有關人員幫助解決問題也是最佳的選擇.
So long as they procrastinate the things in this way, I think finally we will not get any results . I suggest that the evidence of both sides are submitted to a legal arbitration institution by which a final decision is made. Of course, the best choice is to resort to members of Parliament or related personnel to help solve problems .
