Currently, the California Code of Civil Procedure provides that a pending action does not abate by reason of the death of a party if the cause of action survives, and a cause of action for or against a person survives subject to the applicable limitations period unless otherwise provided by statute.”  When a Defendant dies in the middle of litigation, the Plaintiff’s claims do not simply vanish or “abate.” The Plaintiff may continue its claims against the Decedent’s estate. However, in order to do so, a Plaintiff must comply with the requirements of California’s Probate Code.
