"A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." 　）看，如果強調“A well-regulated Militia”，即有完善組織的民兵，是可以解釋成“集體”的，也就是佛吉尼亞家長文中所說的“州的防衛權”。這種“collective rights”的說法，在2008年以前統治美國將近七十年；但對“the right of the people to keep and bear Arms”的解釋，是指“個人”有擁槍權。美國政界法界民間在這個“集體”還是“個人”權利上有長時間激烈的爭議。直到2008年，海勒（Heller)一案，美國最高法院以五比四的比例判決，在法律的層麵確認了擁槍權是個人權力。
