按道理，法律應該有所規定，什麽狀況下軍人可以不服從命令，例如美國陸軍,有如下軍法條規

二、軍人有不服從命令的義務（Duty to Disobey Unlawful Orders）

    軍人有不服從非法命令的義務。有句英文講得堅定有力∶

“  You are not required to obey unlawful orders.”

這個，我們不僅從常識上和邏輯上可以推退出，就是在軍人的宣誓誓言中也講得很清楚。請看以下軍人宣誓誓言∶

Army officer appointment acceptance and oath of office

I （insert name）， having been appointed a 

（insert Rank） in the U.S. Army under the conditions indicated in this document， 

do accept such appointment and do solemnly swear （or affirm） that I will 

support and defend the Constitution of the United States against all enemies， 

foreign and domestic， that I will bear true faith and allegiance to the same；

and that I take this obligation freely， without any reservation or purpose of 

evasion； and that I will well and faithfully discharge the duties of the office 

on which I am about to enter. So help me God. （DA Form 71， 1 August 1959， for 

office.）

 

    Oath of Enlistment I， （NAME）， do solemnly swear （or affirm） that I 

will support and defend the Constitution of the United States against all 

enemies， foreign and domestic； that I will bear true faith and allegiance to 

the same； and that I will obey the orders of the President of the United States 

and the orders of the officers appointed over me， according to regulations and 

the Uniform Code of Military Justice. So help me God.

 

在這裏，1、軍人宣誓捍衛美國憲法，反抗國內和國外的敵人，憲法是根本大法，一切以憲法為準，凡不符合憲法的命令都是非法命令。

 

    2、除憲法外，還必須遵守日內瓦國際公約。該公約第三條規定得很清楚∶“ 非敵對人員，放下武器的敵人，傷病員、俘虜，必須以人道待之，不分種族、性別、宗教信仰、年齡、財產等等。 凡違背這些法律的命令，都是非法的。軍人有義務拒絕執行這些非法的命令。
