It's not 100% legal for sure. If you plan to run for the presidency in 30 years, it certainly does not look good for you (Unless you have destroyed all records like the little Bush did to his national guard service records...).
But from the CBS 60 minutes, if they want to put everyone who has downloaded music into jail, they need to build jail houses to hold at 60 million people in the US only.....
