I do not think you will win.
It happened to my friend before, she is in nursing and at the end of year, and they need to do clinical practice. The instructor fails her and suggests that she should repeat the year again. So, basically, the teacher not just fails her on the subject and also suggests the school to hold her one more year. She applies and the department still stands with her teacher's decision.
At the end, her dad called the department dean and said he is going to sue the school for racism. Finally, school passes her for that course.
The same situation happened again this summer. There really nothing much you can do, just pick the teachers that are nice to foreign students.
