求助：車禍，有證人，保險公司不作為。

我的車正常停在路邊的parking lot，人當時不在車上。被另一試圖趴車在我前邊的車撞到前左側。肇事者把被撞掉的左前燈按上後逃離現場。碰巧被一路過老美和他妻子（女朋友）看到，把對方的車牌號，車型等信息記下，等我回來後交給我並留下他本人的聯係電話。我按程序報警並報告了我的保險公司。對方在收到我方保險公司的信以後，遲遲不理，反倒不知從何途徑找到我老公的郵件地址（車是注冊在我老公名下），發郵件問我們是怎麽知道是他幹的，損失大約是多少。我們告訴他已報保險公司，一切由保險公司處理。我們並將郵件內容轉發保險公司的經辦人。車的損失經估價是一千多美元，我們的deductable 是1000美元。

幾個月裏我都有跟蹤進展。先是對方拒絕提供保險信息。後來估計是我們報告DMV以後沒辦法了，提供了他的保險信息。沒想到的是，事過7個多月，我們等來的結果是保險公司沒辦法recover 我們的損失。收到的信是這樣的：

We have been notified by our collection Vendor, Credit Collection Services Commercial, that this matter, which we presented to binding arbitration, has been decided. Regretfully, the decision was not in our favor.

Because the decision of the panel is final and binding between xxx(name of our insurance company) and the other insurance company, we are forced to end our recovery efforts.

We no longer intend to pursue further collection action against the responsible party. Your are, however, authorized to pursue further collection action on your own.

Please be assured that every available effort was made to recover your deductible.

我給那個老美witness打了電話，問他是否有人聯係過他。他說有2，3 個電話問過他。

在這種情況下，請問我應該怎麽做才能挽回1000美元的損失？是繼續和保險公司交涉，估計沒戲； 還是直接去small claim court告肇事者？還是有什麽更好的辦法？
