Even written acceptance does not mean much. It is the contract that counts. That's why a contract is so long -- there are plenty of "outs", conditions under which either side could back out of a deal. The seller never faxed out the written acceptance, most likely because he/she was trying to hold out for a better offer, and he/she did get it. It happens A LOT. The seller's action is ethically questionable, but it is not illegal. If you want, you can give a higher offer. If not, then just give up. It is not your agent's fault.
