該告誰?

最近通過一中介買房, 原房主在MLS 上列了 “ all appliances included, play set, storage shed, water softener/with reverse osmoses are added bonus.” 我的中介隻列了 “include all appliance: stove, fridge, dish washer, washer, dryer, play set, storage shed and water softener.” 問他為何不列 reverse osmoses? 他說是一樣的. 現在原房主把 reverse osmoses 搬走了, 我該找誰算帳?

1. water softener 是除鈣鎂等硬離子的, 主要用於洗滌/洗澡 , 但除後的水含鈉高,非要用 reverse osmoses 處理後才能飲用, 這倆套係統可以單調安裝. 請問我的中介有理嗎? 他說我該告原房主.

2. 個人認為我的中介沒有盡到他的責任, causing 這些不必要的confusion. 還有他幫我賣房時, 接到 offer 的時候, 同時拿出一買房合約逼著我簽, “想賣房? 先簽買房合約”. 這讓我非常反感. 因要買的房子較遠, 非常不方便, 他總共就沒帶我看幾個房子.

請問我能上 small claim court 告他嗎? 有case 嗎? 或者減他$2000 commission, 讓他告我?
