a nonresident alien individual for tax purposes. He becamse a resident alien for tax purposes 6 years ago. As a result, he should not have claimed the benefits under the treaty for the past 6 years. Needless to say, going forward, you'be better not to do that.

Assuming your income is not very high (I could be wrong), you chance of getting audited is low. In addition, IRS only conducts audits on tax returns for the past three years.

So my advice is do the right thing from now on. After three years, you could be trouble free (but there is no guarantee on that).
