I went to a company four months ago, the company tranfered my H1B and paid all the expenses. When I started the work, I signed a relocation repayment agreement. The following is part of the original agreement:
"In consideration of any payments made to me, or on my behalf to a third party (including but not exclusively relocation, immigration, and tax vendors), relating to my relocation (hereinafter "relocation payments"), I agree to remain in the employ of xxx company for a minimum of 12 consecutive months. Should I voluntarily terminate my employment with the company for any reason prior to the expiration of the minimum period, I agree to repay all relocation payments, including any gross-ups, paid or incurred on my behalf."
I worked for the company for four months, and I do not like it, so I quit the job and went to work for others.
The company ask me to repay the H1b transfer expenses.
Here is my understanding for the contract:
H1B is sponsored by the company, they are the applicant, I am the beneficiary. It is their responsibility to pay all the expenses. So they paid the expenses is not on my behalf to the third party, but on their on behalf to the third part (immigration).
Please provide me some expert opinions.
