everything is based on earning ability, rather than having a job or not at the moment. thus, quitting one's job on purpose should be punished.
2nd attorney could be wrong. if your giving up spousal support was based on the fact that your ex had no earnings (which was fraud on your ex's part by not disclosing the facts), then you should be able to set it aside and ask for it. call around and find a good attorney to represent you. not sure 10k will be worth it though. attorney fee can run up rather quickly.
