She may be out of luck

As far as I know, she has to be a New York resident for at least 30 days in order to sue for child support. It does not matter where the father is though as long as he can be located within US. Different states may have different residence requirements, but it is highly unlikely that it can be waived. Some states may have reciprocal agreement with some of the foreign countries. Unfortunately none has one with China. I've seen a similar case and that Mom was able to come to New York to meet the residence requirement. Is it possible for the Mom to come to New York on B-1/2 visa and stay for at least 30 days. If she can, send me 悄悄話
