問個問題，老公的車被沒有保險的給撞了，該怎麽辦？

警察的報告寫的很清楚是對方的錯。當時那人也填了保險公司的信息，但是我們的保險公司和那邊一聯係，發現他已經幾個月前CANCEL了他的保險。
請問，這種情況下我們應該怎麽辦？我們自己的保險隻有責任險(LIABILITY)，這種對方的責任的情況應該不在保的範圍。如果去告對方，又是傷財勞神。那人是個黑人，幹粗活的那種，開一個破卡車，一看就沒什麽錢的。讓他自己掏錢，恐怕不可行。最多判他入獄，我們也得不到賠償了呀。

真是好頭疼！請指教。
