It happened to me long time ago. I live in TX. I was almost killed.
I talked with a lawyer and he told me no chance in TX.

Do you have no-fault auto accidental in IL?

If you have uninsured/under-insured protection for your call, you can use that. Otherwise, use Collision if it is a big money to fix your car. In this case, your insurance probably will go up.

Anyway, you can talk to a lawyer since you are in differenct place.
